Dramatic Increase In Employment Tribunals

Employment tribunal claims are expensive, time consuming and stressful to employers and often they could be avoided.

The news from the Ministry of Justice confirming that the total number of employment tribunals for single claims in the 3 months between April and June 2018 were 10,996 across the UK, coupled with 42,700 multiple claims, is concerning. In terms of awards, disability discrimination claims’ pay-outs had an average of £30,700.

September 2018’s top employment law cases, according to People Management, included a pilot who listed Star Wars villain Jabba the Hutt as a reference had to pay back £5,000 training costs to airline West Atlantic. Further, an employer who dismissed attempted kisses as cultural misunderstanding was told to pay £24,000 in a sex discrimination case. Although these cases are ‘different’, the costs are still significant.

It should be noted by employers that there has been a 130% increase in single claims since July 2017, when there was an abolition of tribunal fees to employees. The significant impact for employment tribunal cases could be reduced by employers using the correct policies and procedures, conducting training and gaining early advice to prevent claims in the first place.
