Follow A Procedure To Prevent A Claim
The tribunal case of a teacher, who was awarded £3,000 in an unfair dismissal claim, reminds employers of the necessity to follow the correct procedure.
The school in question did not follow the correct statutory three-step procedure as the teacher, who had been at the school for over 2 years, was not given an interview or the opportunity to appeal against her dismissal.
It is interesting to note that this was deemed unfair dismissal and not wrongful dismissal, as they can be confused. However, in either circumstance, the eventual outcome will remain the same if employers do not follow the correct and legally binding procedure.
